Yep, there you go, I had to say it just for the record. There is still a lot of confusion in the healthcare compliance marketplace with some folks still holding onto some hope that the HITECH Act is just a bad dream that is going to go away.
The horse left the barn a long time ago on the HITECH Act. There are no Republicans that I am aware of calling for it to be repealed. Privacy and security appear to be popular issues with legislators on both sides of aisle. Why? Because voters care about these issues! Sure there are lots of Republicans (all?) calling for the repeal of Obamacare, but the latter has NOTHING to do with the HITECH Act.
If you are implementing an EHR then complying with the HITECH Act and the HIPAA Security Rule is not optional--treat as such as your own peril. There are many ways to be found to be in willful neglect, but ignoring a regulatory regime that has been law now for three years is certainly one of the Top Five Compliance Strategies guaranteed to fail.
